Science and Technology

SECTION 10.
Science and technology are essential for national development and progress. The State shall give priority to research and development, invention, innovation, and their utilization; and to science and technology education, training, and services. It shall support indigenous, appropriate, and self-reliant scientific and technological capabilities, and their application to the country’s productive systems and national life.

SECTION 11.
The Congress may provide for incentives, including tax deductions, to encourage private participation in programs of basic and applied scientific research. D. REPUBLIC ACT NO. 6735

AN ACT PROVIDING FOR A SYSTEM OF INITIATIVE AND REFERENDUM AND APPROPRIATING FUNDS THEREFOR

Be it enacted by the Senate and House of Representatives of the Philippines in Congress assembled:

I.—General Provisions

SECTION 1. Title.—This Act shall be known as “The Initiative and Referendum Act.”

SEC. 2. Statement of Policy.—The power of the people under a system of initiative and referendum to directly propose, enact, approve or reject, in whole or in part, the Constitution, laws, ordinances, or resolutions passed by any legislative body upon compliance with the requirements of this Act is hereby affirmed, recognized and guaranteed.

SEC. 3. Definition of Terms.—For purposes of this Act, the following terms shall mean:

(a) “Initiative” is the power of the people to propose amendments to the Constitution or to propose and enact legislations through an election called for the purpose.

There are three (3) systems of initiative, namely:

a.1 Initiative on the Constitution which refers to a petition proposing amendments to the Constitution;

a.2 Initiative on statutes which refers to a petition proposing to enact a national legislation; and

a.3 Initiative on local legislation which refers to a petition proposing to enact a regional, provincial, city, municipal, or barangay law, resolution or ordinance.


E. REPUBLIC ACT No. 11035

An Act Institutionalizing the Balik Scientist Program, Appropriating Funds Therefor, and for Other Purpose.

Be it enacted by the Senate and House of Representatives of the Philippines in Congress assembled:

Section 1. Title. - This Act shall be known as the "Balik Scientist Act."

Section 2. Declaration of Policy. - The State recognizes that the utilization of the expertise of science, technology or innovation experts of Filipino descent is a vital component of the national political, economic, and social development efforts. Hence, it is hereby declared the policy of the State to support the participation of science, technology or innovation experts of Filipino descent in research and development initiatives for our country,

Towards this end, science, technology or innovation experts, such as scientists, professionals, educators, technicians, researchers, engineers, innovators, technologists, technology entrepreneurs or any person with special skills or expertise, who is of Filipino descent, shall be accorded with benefits, incentives and privileges under this Act to encourage and support their participation in strengthening the scientific and technological human resources of public or private institutions and industry in our country to accelerate the development of new or strategically important technologies that that are vital to our national development progress.

Section 3. Balik Scientist Program. - There is hereby created a Balik Scientist Program, hereinafter referred to as the "Program", to be administered by the Department of Science and Technology (DOST).

Under the Program, the DOST shall:

(a) Survey and identify scientific and technological expertise absent or limited locally which may be addressed by a Balik Scientists in coordination with the host institution(s);

(b) Manage and facilitate the processing of the applications and awards for short-term, medium-term, or long-term engagement of Balik Scientists in coordination with the host institution(s);

(c) Provide and facilitate the release of the appropriate benefits and incentives provided under this Act to Balik Scientist who have passed the application process of the DOST in coordination with the respective host institution(s);

(d) Issue the appropriate rules and regulations for the efficient provision of benefits and incentives, which shall include the clarification of pertinent rules and regulations promulgated and administered by other government agencies;

(e) Monitor the implementation of the Program, in coordination with the respective host institution(s) and the fulfillment of the agreed obligations and responsibilities of Balik Scientist under the Program;

(f) Assess the actual, and/or anticipated impact of each short-term, medium-term, long-term engagement awarded, and the overall implementation of the Program; and

(g) Issue the guiding science, technology, or innovation research and development, and industry development agenda that shall guide the implementation of prioritization in the provision of awards and grants-in-aid provided under this Act.

The DOST shall prioritize the awarding of short-term, medium-term, and long-term engagements, and grants-in-aid provided under this Act that complement or address needs in ongoing or prospective government programs and projects of local and national significance. The DOST shall determine other privileges and incentives that maybe extended to Balik Scientists.

F. FDA ADMINISTRATIVE ORDER

No. 4 s. 1992

SUBJECT : Policy and Requirements for Availing of Compassionate Special Permit

(CSP) for Restricted Use of Unregistered Drug and Device Product/

Preparation.

The Bureau of Food and Drugs (BFAD) recognizes the need for drugs and devices product/preparation which are not registered or are in the process of registration in the Philippines by patients who are terminally or seriously ill. Access to these products for these patients is morally, socially and ethically justified when there is no existing superior alternative therapy that can likely cure or adequately control their conditions.

Therefore, the BFAD shall henceforth provide for a Compassionate Special Permit For Restricted Use of Unregistered Drugs and Devices Product/Preparation when the conditions and requirements specified hereunder exist and are complied with.

A Compassionate Special Permit for Restricted Use of Unregistered Drug and Devices Product shall refer to a special permit signed by the BFAD Director granting a Specialized Institution (SI) and Specialty Society (SS) the privilege to avail of an unregistered drug and device product through a certain licensed establishment for certain kind/type of patients, specific volume and period.

I. A Specialized Institution/Specialty Society shall file a request for CSP only for

patients suffering from the following conditions:

1. Acquired Immune Deficiency Syndrome (AIDS)

2. Cancer

3. Life-threatening conditions

The application shall include the estimated volume needed and the licensed drug/device establishment through which the unregistered drug may be procured.

It shall also identify the names and address of the specialists qualified and authorized to use the product.
